End User License Agreement

END USER LICENSE AGREEMENT (EULA) FOR MOTHERLOVE FERMENTS

IMPORTANT: PLEASE READ CAREFULLY BEFORE USING OUR KOMBUCHA AND WATER KEFIR PRODUCTS.

This End User License Agreement ("EULA") is a legal agreement between you ("End User" or "you") and [Kombucha Company] ("Company" or "we") for the use of our kombucha products ("Products"). By using our Products, you agree to be bound by the terms and conditions of this EULA.

  1. GRANT OF LICENSE: Subject to your compliance with this EULA, the Company grants you a limited, non-exclusive, non-transferable, revocable license to use the Products for personal, non-commercial use only. This license does not grant you any ownership rights or intellectual property rights in the Products.

  2. USAGE RESTRICTIONS: a) You agree to use the Products solely for their intended purpose and in accordance with any instructions provided by the Company. b) You shall not modify, reverse engineer, decompile, disassemble, or attempt to derive the source code of the Products. c) You shall not distribute, sublicense, rent, lease, lend, or otherwise transfer the Products to any third party. d) You shall not use the Products in a manner that violates any applicable laws, regulations, or third-party rights.

  3. INTELLECTUAL PROPERTY: The Products are protected by intellectual property laws and international treaties. The Company retains all rights, title, and interest in and to the Products, including all intellectual property rights. This EULA does not grant you any rights to trademarks, logos, or any other proprietary rights of the Company.

  4. DISCLAIMER OF WARRANTIES: The Products are provided "as is" without any warranties or representations, whether express or implied. The Company disclaims all warranties, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company does not warrant that the Products will be error-free, uninterrupted, or free from viruses or other harmful components.

  5. LIMITATION OF LIABILITY: To the maximum extent permitted by law, in no event shall the Company be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or performance of the Products, even if the Company has been advised of the possibility of such damages.

  6. TERMINATION: This EULA is effective until terminated. The Company may terminate this EULA immediately and without notice if you fail to comply with any of the terms and conditions. Upon termination, you must cease all use of the Products and destroy any copies in your possession.

  7. GOVERNING LAW: This EULA shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising out of or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].

  8. ENTIRE AGREEMENT: This EULA constitutes the entire agreement between you and the Company concerning the use of the Products and supersedes any prior agreements or understandings, whether written or oral.

By using our kombucha Products, you acknowledge that you have read and understood this EULA and agree to be bound by its terms and conditions.
